AACS vows to fight people who publish the key:

Bring it on, boneheads.

As I wrote in The Anarchist in the Library, Sec. 1201 (anti-circumvention) of the Digital Millennium Copyright Act outlaws math.

And that's futile.

And stupid.

And counterproductive.

The key of digits is part of what is needed to decode the digital rights management around HD-DVDs.

As if that’s not weird enough, there are actually millions of other numbers (other keys used in AACS) that AACS LA claims to own, and we don’t know what they are. When I wrote the thirty-digit number that appears above, I carefully avoided writing the real 09F9 number, so as to avoid the possibility of mind-bending lawsuits over integer ownership. But there is still a nonzero probability that AACS LA thinks it owns the number I wrote.

When the great mathematician Leopold Kronecker wrote his famous dictum, “God created the integers; all else is the work of man”, he meant that the basic structure of mathematics is part of the design of the universe. What God created, AACS LA now wants to take away. ...

I read in the Atlantic Monthly last night that Hollywood's total movie and video revenue was merely 45 billion in 2004. That's not much, single companies like Exxon, Microsoft, ATT, and GM gross way more than that, each. I would guess that the operating profit must be in the tens or less, range or the studios wouldn't be, tooth and nail, against the bootleggers and filesharers. I say that because I know that other, even more ripped off industries, like software, have operating margins in the forty to sixty percent range and they are satisfied to do little or nothing about rampant copyright infringement.

If that be the case I don't know how long the studios or recording companies can stay in business under the current model. The studios are engaged in a war of attrition with an enemy that needs no supplies or reinforcements. In fact, I can see that, in just a few more years, the major studios, one by one, will start abandoning the creation and distribution of "big movies" because they won't make enough gross revenue to cover production, marketing, and distribution expenses. The studios are a business, after all, and if a business can't make a profit selling its product then it abandons the product and sells something else. I can't predict what might replace the current regime, but I am certain that the current regime won't last. I give it five years, tops; probably three.

I don't say this as some sort of lament. In fact, I look forward to the movie studio's and recording companie's demise. My attitude is good day and good riddance.

Interesting to pay attention to how the finely the law is splitting on this. One guy who was issued a takedown notice on his Google notebook page didn't delete they key - he just deleted the terms "HD DVD processing key" and apparently that was good enough for Google.

The key on its own isn't covered by the DMCA - the number itself isn't actually copyrighted, although it's included in the protection - Google's actions indicate that it's the key along with the descriptive words that constitutes a "circumvention device" apparently.

So if you're looking to get in trouble, you should make sure to tack on "HD DVD processing key" somewhere in your post, preferably with some other more explicit instructions as to how to use the key. Of course, my just leaving this comment might be doing this for you :)
