Re-copyrighting Held Constitutional
Scrivenor's Error has a great post about the DC Circuit's recent holding in Luck's Music Library, Inc. v. Gonzales, which affirms the constitutionality of Section 104A of the Copyright Act, which "re-copyrighted" works that had been in the public domain, largely because putative copyright holders had failed to comply with U.S. copyright formalities in effect prior to U.S. adherence to the Berne Convention.
